1. SOURCE AND SCOPE

XO Arcade: Infinity Edition (the “Game”) includes audio created using ElevenLabs.

ElevenLabs was used during content creation. It is not integrated into the Game as a runtime service. Ordinary gameplay does not send player gameplay, device, advertising, analytics, diagnostic, or personal data to ElevenLabs.


2. GOVERNING TERMS

Use of ElevenLabs and generated output is governed by the ElevenLabs terms, product conditions, account tier, plan terms, and policies applicable when each output was created.

3. COMMERCIAL-USE ELIGIBILITY

Commercial-use eligibility may depend on the account, subscription plan, payment status, service or feature used, generation date, applicable terms, and any output-specific restrictions in effect when the audio was created.

This notice does not independently establish that a particular audio file qualifies for commercial use. Eligibility should be supported by contemporaneous records for the specific output.


4. VOICES, INPUTS, AND THIRD-PARTY RIGHTS

The operator remains responsible for having the necessary rights, permissions, and lawful basis for any uploaded audio, voice, text, prompt, cloned voice, professional voice, or other input used to create an output.

This notice does not claim that ElevenLabs endorses the Game, that a generated voice represents a real person, or that every generated output is unique, copyrightable, registrable, or free of third-party claims.

The Game does not provide players with access to ElevenLabs as a voice-generation or cloning service.


5. PROVENANCE EVIDENCE

The factual basis for use of each included output should be supported by records such as:

- the ElevenLabs account used;
- the output or project identifier;
- the generation date;
- the product, feature, or model used;
- the subscription plan active on that date;
- applicable receipts or billing records;
- the downloaded source file; and
- the corresponding filename or use within the Game.

The absence of sufficient records may prevent independent verification of commercial-use eligibility or input authorization.


6. NO ENDORSEMENT OR ADDITIONAL WARRANTY

ElevenLabs and its related names and marks belong to their respective owners. ElevenLabs does not operate, sponsor, or endorse the Game merely because its service was used during content creation.
