TERMS OF SERVICE Tap Odyssey Effective Date: July 24, 2026 Last Updated: July 24, 2026 1. AGREEMENT, OPERATOR, AND ACCEPTANCE These Terms of Service (“Terms”) govern the download, installation, access, and use of Tap Odyssey (the “Game”). These Terms form an agreement between the user and Jesus Afkerian, an individual who operates and publishes the Game under the AFKERIAN INTERACTIVE brand (“AFKERIAN INTERACTIVE,” “we,” “us,” or “our”). AFKERIAN INTERACTIVE is the brand under which Jesus Afkerian publishes the Game and is not presented here as a separate legal entity. To the maximum extent permitted by law, downloading, installing, accessing, or using the Game after these Terms and a reasonably conspicuous notice are made available manifests acceptance of these Terms. Merely keeping the Game installed without accessing or using it does not, by itself, constitute acceptance of a new or modified version of the Terms. If the user does not accept these Terms, the user must not download, install, access, or use the Game. If it is already installed, the user must stop using it and uninstall it. 2. AGE AND LEGAL CAPACITY Tap Odyssey is intended and marketed primarily for persons 18 years of age or older. The Game does not independently verify a user’s age or technically prevent a person under 18 from installing or using it. However, a person under 18, a person who has not reached the applicable age of contractual majority, or a person who otherwise lacks legal capacity to enter into this agreement is not authorized to use the Game under these Terms. The absence of a technical age restriction does not grant contractual authorization to a person who does not meet these requirements. 3. AUTHORIZED TERRITORY The Game is authorized only in the territories identified in the current Permitted Territory document: https://afkerianinteractive.github.io/legal/PERMITTED_TERRITORY.txt Public access to the website, Google Play listing, or legal documents does not authorize use of the Game outside the permitted territory. The user is responsible for not downloading, accessing, or using the Game where doing so is prohibited by applicable law, sanctions, export controls, trade restrictions, or these Terms. 4. LIMITED LICENSE Subject to compliance with these Terms and applicable law, an eligible user is granted a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to install and use the Game on a compatible device for lawful, personal, noncommercial entertainment. The Game is licensed, not sold. The license does not transfer ownership of the Game, its code, design, mechanics, graphics, interfaces, music, sounds, text, characters, names, logos, brand, content, or other materials. Third-party materials remain subject to their own licenses, terms, and notices. 5. OPERATION, LOCAL DATA, AND NO ACCOUNTS Progress, scores, preferences, settings, virtual items, and ordinary game state are stored primarily on the user’s Android device. The Game does not offer or require an account administered by Jesus Afkerian or AFKERIAN INTERACTIVE. There is no first-party player profile synchronized with servers operated by us. The Game currently does not include subscriptions, in-app purchases, account purchases, a user marketplace, transfers of items between users, or publicly posted user-generated content. Local data may be lost, changed, or deleted through uninstalling, clearing application data, corruption, loss or replacement of the device, updates, incompatibility, restoration, Android behavior, or user action. Android backup or transfer features may copy or restore certain data depending on device, Google, and manufacturer settings. We do not guarantee backup, synchronization, recovery, or restoration of progress. The Game may use network connections for advertising, privacy messaging, analytics, crash reporting, installation or session measurement, fraud prevention, and time-dependent or externally supported functions. The Game is not completely offline. 6. ADVERTISING AND REWARDED ADS Tap Odyssey is funded in whole or in part by advertising and may display banner ads, interstitial ads, and optional rewarded ads. When an eligible rewarded ad is completed successfully, the Game may grant the virtual benefit described for that viewing. Availability, playback, measurement, validation, and delivery of the ad or reward are not guaranteed. Rewards, items, scores, currencies, upgrades, and other virtual benefits are not money, have no monetary value outside the Game, cannot be sold, transferred, or redeemed for money, do not represent deposits, financial property, or investment instruments, and may be lost or reset in accordance with these Terms and applicable law. The user may not manipulate or attempt to manipulate ads, consent signals, impressions, clicks, playback, rewards, identifiers, measurement, frequency limits, anti-fraud mechanisms, or ad availability. The absence, failure, or unavailability of an ad does not create a right to receive a reward, compensation, or substitute benefit. 7. PRIVACY The Tap Odyssey Privacy Policy is incorporated into these Terms by reference: https://afkerianinteractive.github.io/tap-odyssey/privacy-policy.html The Game uses Google services related to advertising, privacy management, analytics, crash reporting, installations, and sessions. Accepting these Terms does not constitute general and unlimited consent to every data-processing activity. Collection, use, sharing, retention, controls, and privacy rights are described in the Privacy Policy and applicable provider policies. 8. ACCEPTABLE USE The user may not, and may not assist another person to: - use the Game unlawfully or outside the authorized territory; - copy, sell, rent, sublicense, redistribute, or commercially exploit the Game or any part of it; - create, distribute, or exploit an unauthorized derivative work; - decompile, disassemble, reverse engineer, extract source code, or bypass technical measures, except where a restriction is invalid under mandatory law; - modify, interfere with, damage, overload, or disrupt the Game, a device, a network, or a related service; - introduce malware, malicious code, abusive automation, or tools intended to alter operation; - exploit errors or vulnerabilities; - falsify scores, activity, metrics, ads, clicks, rewards, or consent signals; - evade territorial, technical, advertising, privacy, security, or fraud-prevention controls; - infringe intellectual property, privacy, or other third-party rights; - use the Game to harass, defraud, deceive, or harm another person; - remove or obscure ownership, license, or attribution notices; or - falsely claim a relationship, sponsorship, approval, association, or ownership connected with Jesus Afkerian, AFKERIAN INTERACTIVE, Google, or any third party. 9. INTELLECTUAL PROPERTY AND THIRD-PARTY MATERIALS Jesus Afkerian owns or licenses the Game’s original code, design, content, brand, and other materials. The Game may include third-party software, services, sounds, music, images, tools, generated content, and other materials. Those elements are governed by their applicable licenses, terms, and notices. Applicable third-party notices are available at: https://afkerianinteractive.github.io/tap-odyssey/third-party-notices.html Nothing in these Terms overrides an open-source license, grants rights in third-party marks or content, guarantees exclusivity, registrability, copyrightability, or the absolute absence of third-party claims, or implies sponsorship or approval by a referenced provider. 10. UPDATES, CHANGES, AND AVAILABILITY We may correct, update, modify, rebalance, suspend, or withdraw the Game or any of its features when reasonably necessary. Updates may change features, correct errors, modify compatibility, adjust rewards, scores, or virtual economy, reset or modify local progress, change technical requirements, or discontinue content or features. We do not guarantee permanent availability of the Game, features, ads, rewards, content, updates, compatibility, support, external services, or local data. Mandatory consumer rights remain unaffected. 11. THIRD-PARTY SERVICES AND PLATFORMS Google Play, Android, Google, AdMob, Firebase, device manufacturers, network operators, internet providers, and other third parties operate under their own terms and policies. We do not control their independent systems or guarantee their availability, security, continuity, accuracy, conduct, decisions, advertising content, or compatibility. A link, integration, reference, or availability through a platform does not imply affiliation, sponsorship, or approval. The user must also comply with applicable Google Play terms and the terms of any third-party services used. 12. EXPORT CONTROLS AND SANCTIONS The user may not download, access, export, reexport, transfer, or use the Game in violation of United States export controls, economic sanctions, trade restrictions, restrictions involving prohibited persons, destinations, or uses, or other applicable laws. This section does not represent that the Game is authorized in any territory not included in the Permitted Territory. 13. SUPPORT AND FEEDBACK Support may be offered at our discretion through: afkerian.support@gmail.com The user must not send passwords, financial information, identification documents, medical information, or other highly sensitive data unless expressly requested and reasonably necessary. When the user submits comments, ideas, or suggestions about the Game, the user grants permission to use, adapt, and implement them without an obligation of payment, attribution, or incorporation. The user retains any rights already held in submitted materials. This section does not authorize submission or use of confidential information or content that infringes third-party rights. 14. SUSPENSION AND TERMINATION The license granted by these Terms ends automatically when the user materially breaches these Terms. We may suspend or terminate access or features under our control when reasonably necessary because of unlawful activity, abuse, fraud, security risk, breach, provider requirements, technical impossibility, or discontinuation of the Game. After termination, the user must stop using and uninstall the Game. Provisions that by their nature should continue, including intellectual property, disclaimers, limitation of liability, indemnification, mandatory rights, and dispute provisions, will survive. 15. WARRANTY DISCLAIMER TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAME IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” EXPRESS, IMPLIED, AND STATUTORY WARRANTIES ARE DISCLAIMED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, COMPATIBILITY, DATA PRESERVATION, ERROR-FREE OPERATION, AND UNINTERRUPTED USE. WE DO NOT WARRANT PRESERVATION OF PROGRESS, CORRECTION OF EVERY DEFECT, CONTINUING AVAILABILITY OF ADS OR REWARDS, PERMANENT AVAILABILITY OF THE GAME OR EXTERNAL SERVICES, OR THAT THE GAME WILL MEET EVERY INDIVIDUAL USER EXPECTATION. WARRANTIES AND RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW REMAIN IN EFFECT. 16. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, JESUS AFKERIAN, AFKERIAN INTERACTIVE, AND APPLICABLE LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROGRESS, SCORES, REWARDS, PROFITS, REVENUE, OPPORTUNITY, GOODWILL, DEVICE USE, OR OTHER INTANGIBLE VALUE, REGARDLESS OF THE LEGAL THEORY APPLIED, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR STATUTE. THIS EXCLUSION APPLIES EVEN IF THE POSSIBILITY OF DAMAGE WAS DISCLOSED AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE, TO THE EXTENT LAWFULLY PERMITTED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS, EVENTS, THEORIES, DEVICES, DAMAGES, AND RELIEF ARISING FROM OR RELATING TO THE GAME OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT ACTUALLY PAID DIRECTLY BY THE CLAIMANT TO JESUS AFKERIAN FOR THE GAME DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) USD 100. ADVERTISING REVENUE IS NOT AN AMOUNT PAID BY THE USER. THIS IS ONE AGGREGATE CAP, NOT A SEPARATE CAP PER CLAIM, EVENT, THEORY, DEVICE, AD, DOCUMENT, OR DEFENDANT. Nothing excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury, gross negligence where nonwaivable, mandatory statutory privacy or consumer remedies, or any other liability that cannot lawfully be excluded or limited. 17. LIMITED INDEMNIFICATION To the extent permitted by law, the user will indemnify Jesus Afkerian, operating under the AFKERIAN INTERACTIVE brand, against third-party claims and direct losses only to the extent caused by unlawful use of the Game, material breach of these Terms, infringement of third-party rights, or malicious interference with the Game or related services. Indemnification is subject to causation, reasonable mitigation, reasonably prompt notice when practicable, the user’s reasonable control of the defense through qualified counsel, and the right of Jesus Afkerian to participate at his own expense. It does not cover losses caused by fraud, willful misconduct, nonwaivable gross negligence, or conduct for which indemnification cannot lawfully be required. 18. MANDATORY RIGHTS Nothing in these Terms waives or limits any nonwaivable right relating to consumers, privacy, language, warranties, cancellation, small-claims courts, jurisdiction, forum, or legal remedies. When a provision conflicts with mandatory law, that law will control only to the extent necessary. The remainder of the Terms will continue in effect. 19. GOVERNING LAW AND VENUE These Terms are governed by the laws of the State of Florida, United States, without applying its conflict-of-laws rules, except where mandatory law requires otherwise. Subject to nonwaivable local rights, mandatory consumer forums, and small-claims courts, any dispute must be brought before a court of competent jurisdiction in Orange County, Florida. These Terms contain no mandatory arbitration agreement, arbitration delegation, arbitration opt-out procedure, class-action waiver, or jury-trial waiver. 20. CHANGES TO THESE TERMS These Terms may be updated prospectively. Material changes will be made reasonably conspicuous, identify an effective date, and not apply retroactively unless permitted by law and expressly stated. To the maximum extent permitted by law, accessing or using the Game after the notice and effective date manifests acceptance of the updated Terms. Merely keeping the Game installed without accessing or using it does not constitute acceptance of the updated Terms. If the user does not accept an update, the user must stop using the Game and uninstall it before the stated date. 21. GENERAL PROVISIONS If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue in effect. Failure to exercise a right is not a waiver. A waiver must be express and written. The user may not assign these Terms without consent. Jesus Afkerian may assign them together with a lawful transfer of the Game or related rights, subject to mandatory law. Use of the Game does not create an agency, employment, partnership, association, joint venture, franchise, or representative relationship. Except for licensors or providers expressly protected by a disclaimer or limitation, there are no third-party beneficiaries. We are not responsible for delay or failure caused by events beyond reasonable control, subject to nonwaivable law. These Terms, the Privacy Policy, and incorporated licenses and notices constitute the entire agreement concerning the Game without replacing nonwaivable rights. Provisions concerning ownership, disclaimers, liability, indemnification, mandatory rights, forum, and provisions that by their nature should survive will continue after termination. 22.
