1. SOURCE AND SCOPE

Tap Odyssey (the “Game”) includes visual assets generated using OpenAI services for individuals, including ChatGPT.

OpenAI and ChatGPT were used during asset creation. They are not integrated into the Game as runtime services. The ordinary operation of the Game does not send player gameplay, device, advertising, analytics, diagnostic, or personal data to OpenAI.


2. GOVERNING TERMS AND OWNERSHIP

Use of OpenAI services and outputs is subject to the OpenAI terms and policies applicable when the relevant asset was generated.

As between Jesus Afkerian and OpenAI, and to the extent permitted by applicable law, Jesus Afkerian retains his ownership rights in the inputs and owns the outputs as provided by the applicable OpenAI terms. OpenAI assigns to Jesus Afkerian any right, title, and interest it may have in those outputs, subject to those terms and applicable law.

This notice does not establish that an output is eligible for copyright protection, trademark registration, or any other exclusive right.


3. SIMILAR OUTPUTS AND THIRD-PARTY RIGHTS

Generated outputs may not be unique, and other users may receive the same or similar outputs. OpenAI’s assignment does not extend to another user’s output or to third-party material.

Jesus Afkerian remains responsible for evaluating the assets, confirming their suitability for the Game, and obtaining any additional rights required by applicable law. An output may contain, resemble, or implicate third-party copyrighted material, trademarks, publicity rights, privacy rights, or other protected interests.


4. NO PLAYER ACCESS TO OPENAI

The Game does not provide an OpenAI-powered chatbot, image generator, model endpoint, or other player-facing OpenAI function.

Players do not need an OpenAI account to use the Game, and the Game does not give players access to OpenAI services through the Game.


5. NO ENDORSEMENT OR ADDITIONAL WARRANTY

OpenAI and ChatGPT are names and marks of their respective owners.

OpenAI does not operate, sponsor, or endorse the Game merely because its services were used during asset creation.

Jesus Afkerian does not provide an additional warranty on behalf of OpenAI. Nothing in this notice limits rights or remedies that cannot lawfully be waived.
