The full terms follow, and they control if the two ever seem to differ. - These terms are an agreement between you and Jesus Afkerian, an individual operating under the AFKERIAN INTERACTIVE brand (“AFKERIAN INTERACTIVE,” “we,” “us,” or “our”), about Pocket Bones: Board Games (“Pocket Bones” or the “app”). - You can read these terms at any time at https://afkerianinteractive.com/pocket-bones/terms-of-service.html. - You must be 18 or older to use Pocket Bones. - Pocket Bones is free and shows ads. It has no purchases, no betting of any kind and no prizes. - We give you a personal, non-commercial license to use the app. You may not copy, resell or modify it. - Your games and settings are stored on your phone. We cannot restore them if they are lost. - In Nearby play you connect directly with other people’s phones. We do not run, see or moderate those games. - Pocket Bones FM, its hosts and callers, and the computer opponents are fictional. The radio songs, all voices and most sound effects were made with AI tools. Nothing in the app is professional advice. - The app is provided “as is.” Where the law allows, our total liability is limited to USD 100. - Florida law governs these terms, and disputes go to the courts of Orange County, Florida. There is no arbitration, and you keep any right you have to a jury trial or to a class action. - Our Privacy Policy explains what happens to your information. 2. AGREEMENT AND WHO WE ARE These Terms of Service (“Terms”) apply when you download, install or use Pocket Bones. By using the app, you agree to these Terms. If you do not agree, do not use the app, and uninstall it if it is installed. Google Play’s terms also apply to how you get the app from Google Play. If they conflict with these Terms about the app itself, these Terms control as between you and us. AFKERIAN INTERACTIVE is located in Florida, United States. Jesus Afkerian is the founder and owner of AFKERIAN INTERACTIVE. You can reach us at afkerian.support@gmail.com. 3. WHO MAY USE POCKET BONES You may use Pocket Bones only if: - you are 18 or older and legally able to enter into this agreement; - you are not barred from receiving the app under the laws of the United States or of the place where you live, including United States sanctions and export control laws; and - your use is lawful where you are. Pocket Bones is made for adults. It includes adult talk-radio themes and references to alcohol. The app’s content rating on Google Play describes its content and does not change the minimum age in these Terms. 4. WHERE POCKET BONES IS OFFERED We offer Pocket Bones on Google Play only in the countries we select in Google Play. The list can change. You may not use technical means to get the app in a country where we do not offer it. You are responsible for following the laws of the place where you use the app. You may not download, use, export or re-export the app in violation of United States export control or sanctions laws, or for the benefit of any person or place subject to them. 5. YOUR LICENSE Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to install and use Pocket Bones on Android devices that you own or control, for your own non-commercial entertainment. The app is licensed, not sold. We and our licensors keep all rights not expressly given to you. Open source and other third-party components in the app are licensed under their own terms, listed in our Third-Party Notices (Section 15). Nothing in these Terms limits the rights those licenses give you. 6. WHAT POCKET BONES INCLUDES 6.1 Games and computer opponents Pocket Bones includes dominoes, Mexican Train, chess, checkers, Mahjong solitaire, backgammon, Chinese checkers, Ludo, Reversi and Gomoku. You can play against computer opponents, with other people on the same phone (pass-and-play), and with people nearby (Section 7). Zero and the other table players are fictional characters played by the app on your phone. They are not real people, and they do not use an online artificial intelligence service. 6.2 No accounts, no purchases, no gambling Pocket Bones has no user accounts. It has no in-app purchases, subscriptions or virtual currency. It does not offer betting, wagering or prizes of any kind, and nothing in it has money value. Screens styled like a casino or a sportsbook are a visual style only. 6.3 Domino rule profiles The domino rule profiles, including the one based on the 2018 rules of the Federación Internacional de Dominó (FID), reflect our reading of published rules and common local practice. Results recorded in Pocket Bones, including in competition mode, are not official. We are not affiliated with, and are not endorsed by, the FID or any other federation. 6.4 Notifications If you allow notifications, the app reminds you shortly before a Pocket Bones FM show starts. You can turn reminders off in your phone’s settings. 6.5 Legal documents in the app Starting with version 1.2, the app’s Legal & licenses screen shows these Terms, our Privacy Policy and our Third-Party Notices. The app downloads the current, digitally signed versions from our website and keeps a copy on your phone for offline reading. Until it has downloaded a copy, or if your phone has not been able to download the current version, the app shows the copy included in it or the last copy it downloaded, which may be older. The current version of each document is always the one published on our website, at the addresses in these Terms, with the latest Effective Date. Our Privacy Policy explains these downloads. 7. NEARBY PLAY Nearby play connects your phone directly with other phones near you over Bluetooth and Wi-Fi, using Google Play services. While you host a table, the first 15 characters of your Nearby username are visible to people nearby whose phones are searching for the same game, and when you ask to join a table, the same part of your username is sent to the phone that hosts it. After you connect, the other players’ phones can show your username at the table. Choose a username that does not reveal more about you than you want to share. Before connecting with a new phone, check that the code on both screens matches. Only connect with people you know and trust, and only tap “Remember device” for phones you trust. We do not run any server for Nearby play. We cannot see, record, moderate or settle the games you play with other people, and we are not responsible for what other players do. Your use of Nearby play with others must follow Section 11. Nearby play depends on your phone, its permissions, Google Play services and the phones of other players. We do not promise that it will work on every phone or in every place. 8. POCKET BONES FM AND OTHER CONTENT Pocket Bones FM is a radio station built into the app. It plays from audio stored in the app and does not stream from the internet. The station, its hosts, callers and stories are fictional. Shows discuss topics such as folklore and legends, conspiracy theories, history, religion, money and everyday life, for entertainment. They are not news or factual reporting, and nothing on the station, or anywhere else in the app, is financial, legal, medical, religious or other professional advice. Any resemblance of a character in Pocket Bones, on the radio or at the table, to a real person is not intended. Some content mentions alcohol. Pocket Bones FM also plays short promotions for our other apps (Section 10). 9. CONTENT MADE WITH AI TOOLS Some content in Pocket Bones was made with the help of generative AI tools, including: - the songs on Pocket Bones FM, which were generated with Suno, and the cover art that came with each song file from Suno; and - the voices of the Pocket Bones FM hosts and callers, the voices of the table players, and most of the sound effects in the games and on the radio, which were generated with ElevenLabs. Our Third-Party Notices describe these sources. AI-generated content can be similar to content made for others, and we do not claim that it is unique. 10. ADS Pocket Bones is paid for by ads from Google AdMob. The app shows banner ads, a full-screen ad that may appear after a match you finish, and an optional rewarded ad. If you choose to watch the rewarded ad, the app shows no ads until midnight, local time on your phone, or for 2 minutes if midnight is less than 2 minutes away. You can earn this reward once per day. Ads load only when your phone is online and Google’s consent tool allows it. Google chooses the ads you see. We do not control individual ads, and an ad does not mean we endorse the advertiser. In our AdMob settings we have blocked Google’s alcohol and gambling ad categories. This reduces such ads but may not remove every one. If you see an ad that you believe breaks the rules, tell us at afkerian.support@gmail.com. We do not promise that any ad, including a rewarded ad, will be available. If a rewarded ad fails to load or play, you do not receive the reward, and you are not entitled to anything else. The app also shows cards that promote our other apps in the game menu. You can hide them with the “App recommendations” switch: in Pocket Bones, open Settings, tap the “i” (Information) button, then tap “Legal & licenses.” Pocket Bones FM also plays short audio promotions for our other apps. They are part of the radio audio and cannot be turned off separately. You may not interfere with ads, click ads you are not interested in, use any tool to block ads, or use any tool or trick to fake ad views or clicks or to get a reward without watching the ad. 11. RULES OF USE You may not, and may not help anyone else to: - copy, sell, rent, sublicense or distribute the app or any part of it, including its music, voices, images or 3D models; - modify the app, create derivative works from it, or decompile, disassemble or reverse engineer it, except where the law allows this despite this restriction; - extract the app’s audio, images or models for use outside the app; - remove or change any copyright, license or attribution notice; - use the app to harass, threaten, impersonate, deceive or harm anyone, including through Nearby usernames or player names; - choose usernames or player names that are unlawful, hateful or sexually explicit, or that infringe someone else’s rights; - interfere with other players’ phones or games, or with Google Play services; - cheat in a way that harms other players, or exploit bugs in Nearby play; or - use the app for any unlawful purpose or in breach of these Terms. 12. YOUR DATA ON YOUR PHONE Your games, statistics, settings, usernames and friend list are stored on your phone. We do not keep a copy. They may be lost if you clear the app’s storage, uninstall the app, lose or replace your phone, or if an update or a fault removes them. “Reset data” in Settings permanently erases your match history and statistics. Android’s backup feature may copy some of this data to your Google account, as explained in our Privacy Policy, but we do not guarantee that any data can be backed up or restored. 13. FEEDBACK If you send us ideas or suggestions, we may use them without paying you or giving you credit. Please do not send us anything confidential, or anything you do not have the right to share. 15. OWNERSHIP AND THIRD-PARTY MATERIALS Pocket Bones, including its code, design, text, characters, names, logos, artwork, audio and other content, is owned by AFKERIAN INTERACTIVE or its licensors and, where applicable, is protected by intellectual property laws. These Terms do not give you any right to use our names or logos, including “Pocket Bones,” “Pocket Bones FM” and “AFKERIAN INTERACTIVE.” The app includes software and content from third parties under their own licenses. They are listed, with their license texts, in our Third-Party Notices: https://afkerianinteractive.com/pocket-bones/third-party-notices.html Names of third parties, such as Google, Android, Firebase, AdMob, Suno, ElevenLabs, Poly Haven, Kenney and the FID, belong to their owners. Their mention does not mean that they sponsor or endorse Pocket Bones. 16. UPDATES AND CHANGES TO THE APP We may update Pocket Bones to fix problems, add or remove games or features, change how ads work, or meet legal or platform requirements. Some updates may be required to keep using the app. An update may change or reset saved games, statistics or settings, though we try to avoid that. We may stop offering Pocket Bones, or any part of it, at any time. If we do, these Terms continue to apply to any copy you still have, but we will no longer support it. 17. THIRD-PARTY SERVICES Pocket Bones relies on services run by others, including Google Play, Google Play services, Google AdMob, Google Firebase and, starting with version 1.2, Cloudflare, which hosts our website. They are governed by their own terms and policies. We are not responsible for their availability or for what they do, except as required by law or as described in our Privacy Policy. 18. ENDING THESE TERMS You can end these Terms at any time by uninstalling the app. Your license ends automatically if you materially breach these Terms. We may also end your license if we must do so because of the law or a requirement from Google Play. When your license ends, you must stop using the app and uninstall it. Sections 11, 12, 14, 15 and 19 to 26 continue to apply after these Terms end, to the extent they are relevant. 19. DISCLAIMER OF WARRANTIES TO THE FULLEST EXTENT ALLOWED BY LAW, POCKET BONES IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL WORK ON YOUR PHONE, THAT NEARBY PLAY OR ADS WILL BE AVAILABLE, OR THAT YOUR DATA WILL BE PRESERVED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU. 20. LIMITATION OF LIABILITY TO THE FULLEST EXTENT ALLOWED BY LAW: (A) AFKERIAN INTERACTIVE AND ITS LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, SAVED GAMES, STATISTICS, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED US DOLLARS (USD 100). PAYMENTS WE RECEIVE FROM ADVERTISERS ARE NOT AMOUNTS YOU PAID US. THESE LIMITS APPLY TO ALL LEGAL THEORIES, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE) AND STATUTE. THEY DO NOT LIMIT LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, DEATH OR PERSONAL INJURY, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED BY LAW. 21. INDEMNITY To the extent allowed by law, you will compensate AFKERIAN INTERACTIVE for reasonable losses and costs, including reasonable attorneys’ fees, arising from a claim by a third party caused by your breach of Section 11 or your unlawful use of the app. We will tell you about the claim promptly, and you may take part in the defense with counsel of your choice. This section does not apply to consumers in places where the law does not allow it. 22. GOVERNING LAW AND COURTS These Terms, and any dispute arising out of or related to them or to the app, are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. Any dispute must be brought in the state or federal courts located in Orange County, Florida, and you and we agree to the jurisdiction of those courts. You may instead bring a claim in a small claims court that has jurisdiction. These Terms do not require arbitration. They do not waive your right to a jury trial, and they do not prevent you from taking part in a class action. 23. RIGHTS THAT CANNOT BE WAIVED If you are a consumer, the law of the country, state or province where you live may give you rights that these Terms cannot take away, including the right to bring a claim in your local courts. Nothing in these Terms limits those rights. If the law where you live does not allow a part of these Terms, that part applies only to the extent the law allows. If you live in New Jersey, the limits in Sections 19 to 21 apply only to the extent New Jersey law allows. 24. CHANGES TO THESE TERMS We may change these Terms. The new version will show a new Last Updated date. Starting with version 1.2, the app also downloads the new version and shows it in Legal & licenses (Section 6.5). If a change is material, we will announce it on this page and in the release notes of the app update that brings the change, before the change takes effect. If you live in Quebec, we will give you notice at least 30 days before a material change takes effect, as Quebec law requires. Changes apply from their effective date and do not apply to disputes that arose before. If you keep using the app after a change takes effect, the new Terms apply to you. If you do not agree, stop using the app and uninstall it. 25. GENERAL TERMS - Entire agreement: these Terms, together with our Privacy Policy and the license terms in our Third-Party Notices, are the entire agreement between you and us about the app. - Severability: if a court finds part of these Terms unenforceable, the rest continues to apply. - No waiver: if we do not enforce a part of these Terms, we have not given up the right to enforce it later. - Assignment: you may not transfer these Terms. We may transfer them as part of a merger, acquisition or sale of the app, as long as your rights under them are not reduced. - Events beyond our control: we are not responsible for delays or failures caused by events beyond our reasonable control. - No third-party beneficiaries: only you and we have rights under these Terms, except that our licensors and service providers may rely on Sections 19 and 20. 26. LANGUAGE These Terms are written in English, and the English version controls. We also provide a Spanish version. If the law where you live requires a different rule, that law applies. 27.
